
In order to maintain our system integrity and resources we expect our customers to act responsible. When you use any Lake-Hosting.com.au services, in any form, you automatically agree to the following terms and conditions.
We reserves the right to suspend or cancel a customer's access to any or all services we provided when we decide that the account has been inappropriately used. In short:
- No adult content (Pornography)
- No online gambling
- No Spam
- No unsolicited e-mailing
- No Warez, cracks, copyright infringement
Server abuse
Any attempt to undermine or cause harm to a server, or customer, of us is strictly prohibited.
Unauthorized use of other people's accounts or computers
We will strongly react to any use or attempted use of an Internet account or computer without the owner's authorization. Such attempts include "internet scamming" (tricking other people into releasing their passwords), password robbery, security hole scanning etc.
Any unauthorized use of accounts or computers by a customer, whether or not the attacked account or computer belongs to us, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the seriousness of the attack.
Abuse of Traffic and/or Storage
Our hosting accounts offer unlimited amounts of bandwidth and storage for web sites. The intention is to provide a space to serve web documents. If you require offsite storage for electronic files to allow FTP access for employees or other businesses, you are free to do so. Web accounts found to contain either/or no html documents, a large number of unlinked files with pornographic, tasteless or immorials images are subject to warning, suspension or cancellation at the discretion of our management. Any customer who violates our policies will be notified and given 2 days to remedy the problem. If the problem is not resolved within the alowled 2 day period, the appropriate action (as defined by management) will be taken.
We will be the sole arbiter as to what constitutes a violation of "Abuse of Traffic and/or Storage".
Commercial advertisements with e-mail
Unsolicited commercial advertisements are not allowed in e-mail, and will likely result in account suspension or cancellation.
IRC
We do not allow IRC or IRC bots to be operated on our servers.
Payment Policies
All accounts are set up on a pre-pay basis. No setup fees are charged for any new accounts. All pricing is guaranteed for the term of pre-payment. We reserve the right to change prices at any time, unless other terms have been agreed upon. Any account not brought current within a week (7 days) of e-mail notice or exceeding this time frame in any way is subject to suspension. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies us in writing for a request for termination of services.
Domain Payments
Lake Hosting domain purchasing is subject to availability. All upfront payments for third party domains are required in full unless FREE through a promotion or offer or deal.. It you purchase a domain for two years eg. an AU domain then you need a hosting account to point the domain to. It's not required that you buy a hosting account for two years simply because you've purchased a two year registered domain. But you need to think about this side of things when purchasing domains.
Cancellation
We reserve the right to cancel service at any time. All fees paid in advance for a service will not be paid unless proof is shown that Lake Hosting is at fault/reason for the cancellation. Any violation of policies which results in extra costs will be billed to the customer (i.e. transfer, space, domain purchases etc.)
Any and all refunds will be sent by Paypal only after money owed is paid for domain purchaces and extra costs. So in order to receive your refund you must have a Paypal account or sign up for one.
Lawful Purpose
We reserve the right to refuse service to anyone. Customers may only use our servers for lawful purpose. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets. We expressly forbid anyone from using servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, or pornographic material, or any other material which we deem to be objectionable, including, but not limited to, pornography, satanic materials, and any and all materials of an adult nature. The designation of any materials as such described above is left entirely to the discretion of our management.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, our agents, our customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold us harmless against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with our servers; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from our servers.
Disclaimer
We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaim any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by our Web hosting service and our employees. We reserve the right to revise the policies at any time.
Promotions
FREE DOMAIN NAME & HOSTING : offers a FREE domain name (new domains only NO tranfers) for full payment of yearly hosting accounts. Once the domain is purchased on behalf of the customer any refunds requested after manual domain purchase will be less with the purchase of a domain name. For example: $83.40 - $19 refund amount is $64.40. This is because Lake Hosting takes the domain cost from the hosting account cost to pay for the domain for this offer. Lake Hosting can NOT de-register your domain once it's purchased through our domain registrar. There will be NO extra transactions fees to pay within 60 days of your purchase. Any refunds after 60 days will incur fees which lowers your refund amount returned.
TEXT LINK CODE HOSTING : offers are a win win deal for both Lake Hosting and customers. Customers agree to add footer anchor text to the bottem of each page within their website to receive $20 yearly hosting. If the customer doesn't comply with this offer to add TEXT LINK CODE (that we provide) to their website within 7 days of purchasing this offer, they will be contacted and asked to add anchor text code to their website within the next 48 hours or risk having their account suspended until further notice. Requests for refunds will be refused after this time.
All end-user must adhere to the above policies.
Failure to follow any term or condition will be grounds for immediate account deactivation with or without refund at the sole discretion of our management.
Acceptable Use Policy
Lake Hosting's Acceptable Use Policy ("AUP") is designed to protect Lake Hosting's customers ("Customers") and third parties, further compliance with all relevant laws and regulatLakes, and promote the security and availability of Lake Hosting's network and physical infrastructure. This AUP applies to each Customer's use of the services provided to it by Lake Hosting ("Services") and every server or network device that is under each Customer's control and attached to Lake Hosting infrastructure as a part of the Services ("Server").
This AUP is incorporated by this reference into each Customer's service agreement. Lake Hosting reserves the right to amend this AUP from time to time, and a Customer's use of the Services after changes to the AUP are posted on Lake Hosting's web site www.Lake.hosting.com.au will constitute the Customer's acceptance of any such amendments.
Customers are responsible for complying with this AUP and for violations attributable to their customers and users, whether authorized or not by Customer. Customers must take all reasonable steps to ensure that their customers and users will comply with this AUP.
This AUP does not (a) obligate Lake Hosting to monitor, review, or police the data and content residing on its network or (b) create any obligation of Lake Hosting to any party that is not a Customer. Lake Hosting expressly disclaims any liability for the data and content residing on its network and for the actions of its Customers.

Prohibited Content
Customers shall not allow the posting, transmission, or storage of data and content on or through the Services which, in Lake Hosting's sole determination, constitutes a violation of any relevant law, regulation, ordinance, or court order. Customers shall be responsible for determining what laws or regulations are applicable to their use of the Services.
A Customer shall not knowingly host on its Servers, or transmit over Lake Hosting's network, any material believed by Lake Hosting to constitute child pornography. In addition to the any other actions it may take under this AUP, Lake Hosting reserves the right to cooperate fully with any criminal investigation of content located on a Server that constitutes alleged child pornography.
Customer Security Obligation
Customers must use reasonable care to ensure the security of each Server. A Customer is solely responsible for any intrusions into, or security breaches of, any of its Servers, except to the extent expressly provided for in, and covered by, a designated security administration or firewall security service package ordered by the Customer. Lake Hosting reserves the right to disconnect without provisioin of service credit any Servers which disrupt Lake Hosting's network or any hardware objects on the network as a result of a security compromise.
Network Abuse
Customers are prohibited from engaging in any activities that Lake Hosting determines in its sole discretion to constitute network abuse, including the following:
- Introducing or executing malicious programs into any network or server, such as viruses, worms, Trojan Horses, and key loggers.
- Causing or initiating security breaches or disruptions of network communication and/or connectivity, including port scans, flood pings, email-bombing, packet spoofing, IP spoofing, and forged routing information.
- Executing any form of network activity that will intercept data not intended for the Customer's server.
- Evading or circumventing user authentication or security of any host, network or account, including cracking, brute-force, or dictLakeary attacks.
- Interfering with or denying service to any user, host, or network other than the Customer's host, such as a denial of service attack or distributed denial of service attack.
- Conduct designed to avoid restrictions or access limits to specific services, hosts, or networks, including the forging of packet headers or other identification information.
- Using any program, or sending messages of any kind, designed to interfere with or disable a user's terminal session.
Intellectual Property Infringement Policy
Customers may not transmit, distribute, download, copy, cache, host, or otherwise store on a Server any information, data, material, or work that infringes the intellectual property rights of others. Lake Hosting has the right to disable access to, or remove, infringing content to the extent required under any law or regulation, including the Digital Millennium Copyright Act of 1998.
Lake Hosting reserves the right to suspend permanently or terminate the Services of any Customer that repeatedly violates Lake Hosting's Intellectual Property Infringement Policy or any copyright law.
E-mail Policy
Customer may not send unsolicited bulk messages over the Internet (i.e., "spamming") and must comply with all relevant legislation and regulations on bulk and commercial e-mail, including the CAN-SPAM Act of 2003.
Mass Mailings – Customers may not send mass unsolicited e-mail, which is email that is sent to recipients who have not double-opted in to mailings from the Customer. Customers who send mass mailings must maintain complete and accurate records of all consents and opt-ins, including the actual e-mail and its headers, and provide such records to Lake Hosting upon its request. If a Customer cannot provide positive and verifiable proof of such consents and opt-ins, Lake Hosting will consider the mass mailing to be unsolicited.
Mailing Lists – Customers are prohibited from operating mailing lists, listservs, or mailing services that do not target an audience that has voluntarily signed up for e-mail information using a double opt-in process or that has made their e-mail addresses available to Customer for distribution of information. Customers who operate mailing lists must maintain complete and accurate records of all consents and opt-ins (including the actual e-mails and their headers) and provide such records to Lake Hosting upon its request. If a Customer cannot provide positive and verifiable proof of such consents and opt-ins, Lake Hosting will consider the list mailing to be unsolicited. Any Customer-maintained mailing list must also allow any party on the list to remove itself automatically and permanently.
Other prohibited mailing activities include the following:
- Use of Lake Hosting's network for the receipt of replies to unsolicited mass e-mail
- Forgery of e-mail headers ("spoofing")
- Spamming via third-party proxy, aggregation of proxy lists, or installation of proxy mailing software
- Configuration of a mail server to accept and process third-party messages for sending without user identification and authentication
- Hosting web pages advertised within "spam e-mail" sent from another network ("spamvertising")
- Block Removal – If, as a result of a Customer's actions, Lake Hosting's mail servers or IP address ranges are placed on black hole lists and other mail filtering software systems, Lake Hosting shall charge Customer $100 upfront and $100 per hour thereafter for any necessary remedial actions.
IP Allocation
A Customer shall not use IP addresses that were not assigned to it by Lake Hosting. Lake Hosting reserves the right to suspend the network access of any server utilizing IP addresses outside of the assigned range.
IRC Policy
Customers may not operate and maintain IRC servers which connect to global IRC networks such as Undernet, EFnet, DALnet. Use of IRC plug-ins, scripts, add-ons, clones or other software designed to disrupt or deny service to other users is prohibited. Harassing or abusive IRC activity is expressly prohibited under the AUP, including (i) disruption or denial of service or (ii) the use or joining of "botnets" or the use of IRC BNC's or other proxy and re-direction software. If a Customer's IRC servers are frequently compromised or attract denial of service or distributed denial of service attacks that disrupt or denies service to other Customers or users, Lake Hosting may null-route, filter, suspend, or terminate that Customer's service.
Usenet Policy
Usenet posts and content must conform to standards established by the Internet community and the applicable newsgroup charter. Lake Hosting reserves the right to determine whether such posts violate the AUP.
Legal Investigations
Customers will cooperate and comply with any civil or criminal investigation regarding content located on its Servers, including, without limitation, the following: discovery orders, subpoenas, freeze orders, search warrants, information requests, wire taps, electronic intercepts and surveillance, preservation requests, and any other order from a court or government entity (each an "Investigation"). Lake Hosting reserves the right to comply with any Investigation without notice to a Customer. Customers shall not be entitled to service credits, and Lake Hosting shall not be in default under any agreement for Services, if its compliance with any Investigation causes a Customer to incur downtime or requires the sequestering of all or a portion of the Servers.
Violations of AUP
Lake Hosting may enforce this AUP with or without notice to a Customer by any actions it deems necessary in its sole discretion, including the following:
- Disabling access to a Customer's content that violates this AUP
- Removal of DNS records from Servers
- Blocking mail or any other network service
- Effecting IP address null routing
- Suspending or terminating of a Customer's service
- Taking direct action against a Customer's users and customers.
The aforementioned list of actions shall not be construed in any way to limit the actions or remedies that Lake Hosting may take to enforce and ensure compliance with this AUP. Lake Hosting reserves the right to recover any and all expenses, and apply any reasonable charges, in connection with a Customer's violation of this AUP. No service credits will be issued for any interruption in service resulting from violations of this AUP.
Lake Hosting reserves the right at all times to investigate any actual, suspected, or alleged violations of this AUP, with such investigatLake to include accessing of data and records on, or associated with, any Server.

Our Basic Privacy Policy

Lake Hosting reserves the right to request any additional information necessary to establish and maintain your account for use of the Pay Services.
Confidentiality.
Registration Data is the property of Lake Hosting, subject to and protected by the Electronic Communications Privacy Act. Lake Hosting will not sell, rent, swap, or otherwise disclose your Registration Data to any third party. Lake Hosting maintains a secured area on the Site for transmission of Registration Data, and stores all Registration Data in a private database which is not connected to the Internet.
Uses of Registration Data.
Cancellation. You may cancel your account at any time by sending an e-mail to support@lake-hosting.com.au or canceling it yourself through your whmcs members login. Once Lake Hosting has finished processing the cancellation, Lake Hosting will delete all your Registration Data from its database.
No Liability for Acts of Third Parties. Although Lake Hosting will use all reasonable efforts to safeguard the confidentiality of the Registration Data, transmissions made by means of the Internet cannot be made absolutely secure. Lake Hosting will have no liability for disclosure of Registration Data due to errors in transmission or unauthorized acts of third parties.
Use of Aggregated Information. Lake Hosting reserves the right to disclose to third parties information about Subscriber usage of the Lake Hosting Web site and any related services, including information gathered during your use of the Site. Any information disclosed will be in the form of aggregate data (such as overall patterns or demographic reports) that does not describe or identify any individual user.
Updates. Lake Hosting reserves the right to change or update this Privacy Policy, or any other company policy or practice, at any time with reasonable notice to users of the Site. Any changes or updates will be effective immediately upon posting to the Site.
